These Terms are provided for general website-use purposes and are not a substitute for legal, regulatory, or clinical compliance advice. Because health care, behavioral health, telehealth, privacy, billing, and consumer-protection laws change and may vary by service, payer, clinician license, and patient location, Blue Heron Neurofeedback & Counseling should have these Terms reviewed periodically by qualified counsel and compliance personnel.

1. Acceptance of Terms

By accessing or using this website (“Site”), you agree to these Terms & Conditions (“Terms”) and our Notice of Privacy Practices. If you do not agree, please discontinue use of the Site.

2. Purpose of Website

This Site provides general information about our outpatient mental health (MH), substance use disorder (SUD), and medication-assisted treatment (MAT) services. Use of the Site does not create a provider-patient relationship, does not establish eligibility for services, and does not replace professional evaluation, diagnosis, treatment, or medical advice. The Site is not intended for emergencies.

If you are experiencing a mental health emergency, call 911 or the 988 Suicide & Crisis Lifeline (call or text 988). Do not use this website, standard email, voicemail, or web contact forms to communicate urgent health needs, because those channels may not be reviewed immediately.

3. Service Area & Telehealth

We provide services in New Hampshire, Maine, and Vermont through both in-person sessions at our Littleton, NH office and telehealth, when clinically appropriate and permitted by applicable law, licensure rules, payer requirements, and patient location at the time of service. We do not provide services outside the United States.

Telehealth services are subject to a separate informed consent process that covers the benefits and limitations of telehealth, technology requirements, privacy and security considerations, what to do if a session is interrupted, emergency backup procedures, provider licensure in your state, and applicable state-specific disclosures. You will be asked to complete telehealth consent before your first telehealth appointment.

Requirements may vary based on the patient’s state, the clinician’s license, the type of service provided, and the patient’s payer or benefit plan. Where New Hampshire, Maine, Vermont, federal law, payer rules, or professional licensing requirements impose stricter obligations than these Terms, the stricter requirement will apply.

4. Privacy, HIPAA & Website Data

4a. HIPAA Compliance

We comply with HIPAA and applicable federal and state privacy laws. Please review our Notice of Privacy Practices for details on how your health information is used and protected. Do not submit protected health information (PHI) through unsecured channels such as standard email or web contact forms.

If we provide substance use disorder diagnosis, treatment, or referral services that are subject to 42 CFR Part 2, related records may receive additional federal confidentiality protections beyond HIPAA. We will use and disclose Part 2-protected information only as permitted by applicable law and any required written consent, court order, or other legally recognized authorization.

4b. Website Cookies & Tracking Technologies

This Site may use cookies, web beacons, and similar tracking technologies to improve user experience and analyze Site traffic. Some of these technologies may collect information such as your IP address, browser type, pages visited, and time spent on the Site.

Important for HIPAA: We do not use third-party advertising trackers or analytics tools that transmit PHI to outside parties. If you have a patient portal account or use any authenticated features, those sessions are governed by our HIPAA-compliant platform agreements and do not share your health data with analytics vendors.

You may disable cookies through your browser settings. Disabling cookies may affect certain Site features but will not impact your ability to receive care.

5. Your Right to a Good Faith Estimate

Federal Law Notice: Under the No Surprises Act (effective January 1, 2022), you have the right to receive a Good Faith Estimate of the cost of your health care services before you receive them.

If you are uninsured, or if you choose not to use your insurance for a service, you have the right to request a Good Faith Estimate before scheduling. The estimate will include expected costs for the specific service(s) you are requesting, including any related items or services.

If you receive a bill that is at least $400 more than your Good Faith Estimate, you may be able to dispute the bill. For questions or to request a Good Faith Estimate, contact us at (603) 356-6400.

For more information about your rights under the No Surprises Act, visit: https://www.cms.gov/nosurprises

This Site is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by applicable law, Blue Heron Neurofeedback & Counseling disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits rights, remedies, or obligations that cannot be limited or waived under applicable federal or state law.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this Site or its content. This limitation applies only to website use and does not limit rights or remedies that cannot be waived under applicable law.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Hampshire and applicable U.S. federal law, without regard to conflict of law principles.

Any dispute arising from your use of this Site shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Grafton County, New Hampshire, unless you opt out of arbitration by providing written notice to us within 30 days after first accepting these Terms. Nothing in this section prevents either you or Blue Heron Neurofeedback & Counseling from seeking emergency injunctive or equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm, or from pursuing any claim or complaint that cannot lawfully be required to proceed in arbitration.

Notice of Privacy Practices

Effective Date: January 06, 2026

Blue Heron Neurofeedback & Counseling

Our Legal Duties

We are required by law to maintain the privacy of your protected health information (PHI), provide you with this Notice, and abide by it. We will notify you following a breach of unsecured PHI, consistent with HIPAA’s Breach Notification Rule. For Part 2 substance use disorder (SUD) records, breach notification is also required under the 2024 final rule aligning Part 2 with HIPAA.

How We May Use and Disclose Your Information (HIPAA)

We may use or share PHI without your written authorization for treatment, payment, and health care operations (TPO). Other permitted uses include public health, oversight, judicial proceedings, law enforcement, and as otherwise required by law.

Additional Protections for SUD Records (42 CFR Part 2)

If you receive services in a Part 2 program or we hold Part 2-protected records, federal law imposes stricter privacy rules. Part 2 generally requires your written consent for disclosures, with limited exceptions (medical emergency, audit/evaluation, court order). Under the 2024 final rule, you may provide one consent allowing future uses/disclosures for TPO, and HIPAA-covered entities may redisclose in line with HIPAA.

Required Redisclosure Warning

This record which has been disclosed to you is protected by Federal confidentiality rules (42 CFR part 2). The Federal rules prohibit you from making any other use or disclosure of this record unless: (i) express written consent of the patient; (ii) you are a HIPAA covered entity/business associate and received the record for treatment, payment, or health care operations; or (iii) you received the record as permitted by 45 CFR part 164, subparts A and E. A general authorization for the release of medical or other information is NOT sufficient for this purpose.

Your Rights

You have the right to access and obtain a copy of your PHI, request amendments, receive an accounting of disclosures, request restrictions, and obtain confidential communications. You also have the right to revoke consent for Part 2 disclosures and file complaints without retaliation.

Complaints

If you believe your privacy rights have been violated, you may contact us or file a complaint with the U.S. Department of Health & Human Services, Office for Civil Rights (OCR). We will not retaliate for filing a complaint.

Changes to This Notice

We may change our privacy practices and update this Notice. The updated Notice will apply to PHI we already have and to new PHI we receive, and will show the new effective date.

You waive the right to participate in class actions. This does not affect any non-waivable rights under state or federal law.
